39 Arrested in ICE Raid in Odessa, TX
39 people were arrested by U.S. Immigration & Customs Enforcement (ICE) and local authorities today. ICE moved into a local construction site at the Tuscany at Faudree Apartments in Midland County, blocked the exits and had a “roundup” of illegal workers.
The contractor, McDougal Companies, stated that the only illegal workers were from subcontractors used on the job and that all of their direct employees had been released. Even so, you can bet that no work was done today and now they’ll be scrambling to replace the subcontractors helped get them into this mess. When all is said and done, there will be substantive delays and costs that could have been avoided.
McDougal could have had a different story, if they had insisted that their subcontractors verify the work eligibility of their employees. This is why many large box retailers such as Walmart, Verizon, Lowes and Home Depot require their contractors and subcontractors to perform Form I-9 verification and certification. The goal is to have a 3rd party auditor review the employers Forms I-9 and confirm that they appear to be correct. They are placing these clauses within their contracts and requiring this I-9 certification to be completed before the contractor or subcontractor’s employees can be placed on the job.
